Current rules about Visa and Stay Permit (July 2020)

IMMIGRATION STAY PERMIT SERVICES IN NEW NORMAL ORDER

CIRCULAR LETTER No: IMI-GR.01.01-1102 TAHUN 2020

Grant of Entry Permit

1) Foreigners who are ITAP and / or IMK holders and ITAS holders whose validity period has expired and are abroad, who have received notification from the Technical Ministry or a recommendation from BKPM, to re-enter the territory of Indonesia to extend their residence permit, within the longest period 60 days since the issuance of this circular.
2) Foreigners who do not meet the conditions referred to in number 1) who will re-enter the territory of Indonesia are required to apply for a new visa in accordance with applicable regulations.

The return of ITAS and ITAP holder that has status expires

1) Foreigners who are ITAP and / or IMK holders and ITAS holders whose validity period has expired and are abroad, who have received notification from the Technical Ministry or a recommendation from BKPM, to re-enter the territory of Indonesia to extend their residence permit, within the longest period 60 days since the issuance of this circular.
2) Foreigners who do not meet the conditions referred to in number 1) who will re-enter the territory of Indonesia are required to apply for a new visa in accordance with applicable regulations.

Extention of ITK, ITAS and ITAP That Still Valid

Foreigners who are ITK, ITAS and ITAP holders who are still valid and are in Indonesia, can apply for an extension of their residence permit at the Immigration Office in accordance with applicable regulations

Return of ITKT Holder Status

1) Visit Stay Permit Holders

a) Foreign ITK holders who have obtained ITKT, can extend their residence permit based on previous ITK during the covid-19 pandemic period has not ended and there is no means of transportation to return to their country of origin either directly or indirectly.
b) Foreigners who have extended ITK as referred to in letter a) can apply for the transfer of status to ITAS in accordance with statutory provisions.
c) Extension as referred to in letter a) must be made within 30 days from the issuance of this circular.
d) Foreigners who do not meet the provisions referred to in letters a) and b) and c) are subject to Immigration Administration Measures in accordance with the provisions in force.

2) Limited Stay Permit Holder (ITAS)

a) Foreign ITAS holders who have obtained ITKT can apply for an extension of residence permit based on previous ITAS.
b) Foreigners who have extended ITAS as referred to in letter a) can apply for the transfer of status to ITAP in accordance with statutory provisions.
c) Foreigners holding ITAS who have obtained ITKT and cannot be extended in accordance with applicable regulations, are required to leave Indonesian territory within a period of 30 daysfrom the issuance of this circular.
d) Foreigners who do not meet the provisions referred to in letter b) are subject to Immigration Administration Measures in accordance with the provisions of the applicable regulations.

3) Holders of Permanent Stay Permits (ITAP)

a) Foreigners who hold ITAP who have obtained ITKT can apply for an extension of their residence permit based on previous ITAP.
b) Foreigners who are ITAP holders who have obtained ITKT and cannot be extended in accordance with applicable regulations must leave Indonesia within 30 days after the issuance of this circular.
Foreigners who do not meet the provisions referred to in letter b) are subject to Immigration Administration Measures in accordance with the provisions of the applicable regulations.

Visit Visa Holders Upon Arrival (VKSK)

1) Foreigners holding VKSK who have obtained ITKT can extend their residence permit based on previous VKSK until the covid-19 pandemic period ends and there is no means of transportation to return to their country of origin either directly or indirectly.
2) The extension referred to in number 1) must be made within 30 days from the issuance of this circular.
3) Foreigners who do not meet the provisions referred to in numbers 1) and 2) are subject to Immigration Administration Measures in accordance with the provisions in force

Visa-Free (BVK) Visa Holders

1) Foreigners holding BVK who have obtained ITKT must leave Indonesia within 30 days from the issuance of this circular.
2) Foreigners who do not meet the provisions referred to in number 1) are subject to Immigration Administration Measures in accordance with the provisions of the applicable regulations.

ITK and ITAS holders who already have a telex visa and notification

1) Foreigners who hold ITK and ITAS who already have telex visas, notifications from the Ministry of Manpower and recommendations from BKPM who are in Indonesian territory can apply for the provision of ITK and ITAS to the local immigration office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad.
2) ITK and ITAS as referred to in number 1) can be given after paying the Non-Tax State Revenue (PNBP) sticker or visa label at the local immigration office in accordance with Item 3 of Immigration Services Letter B Attachment to the Government of Indonesia Regulation Number 28 of 2019 concerning Types and Rates of Types of Revenues Non-Tax State That Applies to the Indonesian Ministry of Law and Human Rights.
3) The visa fee as referred to in number 2) is paid by using the VKSK and VITAS on Arrival services by first making a Billing Simponi as the basis for payment.
4) Proof of payment of VKSK and VITAS PNBP Upon Arrival as referred to in number 3) is considered as Proof of Having a Visa.

This Circular Letter shall be effective from July 13, 2020 until further decisions are made
